Many legal acts of the Union were adopted without an expiry date. These acts remained formally in force even if their legal effects had been exhausted. Eliminating acts that are no longer applicable or relevant permits a more user-friendly presentation and more efficient and time-saving scrutiny of tools that facilitate access to Union law.

The proposal was put forward following the intentions made clear by the REFIT Communication from 2014, which announced the Commission was preparing repeals of legislation, among others, in relation to standardized reporting in the area of environment. The 2015 Better Regulation Communication also called for a broad review of reporting in several policy areas, including the environment.

Given these links, the repeal of Council Directive 91/692/EEC of 23 December 1991 standardizing and rationalizing reports on the implementation of certain Directives relating to the environment is addressed by the proposal. This is also linked to a wider Fitness Check for environmental monitoring and reporting. That Fitness Check was underway, as set out in the Commission's Work Programme 2016, which mentioned the proposal for repeal of Directive 91/692/EEC and the related water questionnaire Decision 95/337/EEC under repeal initiatives in Annex V.

Summary:

The European Commission put forward on 15 December 2016 a proposal for a Decision repealing the standardised reporting directive [Directive 91/692/EEC] and amending 6 related legal acts.

The Council of the European Union's Committee of Permanent Representatives adopted its position on the proposal on 4 October 2017. Swift negotiations between the EU institutions allowed for an informal agreement on a compromise text to be reached on 22 November. The Council officially endorsed it on 14 May 2018.

The European Parliament and the Council adopted a Decision on the proposed amendments on 30 May 2018.
