The draft law was put forward to modernise and replace Directive 2009/22/EC on injunctions for the protection of consumers' interests (also known as the Injunctions Directive). It is aimed at improving the effectiveness of the injunction procedure and contributing to the elimination of the consequences of the infringements of EU law which affect the collective interests of consumers.

The legislative initiative was put forward by the European Commission on 11 April 2018 as part of a legislative package on consumer protection. This was a follow-up to the REFIT Fitness Check of EU consumer and marketing law, of which results were published in May 2017. It also followed a Report from the European Commission on the implementation of Recommendation 2013/396/EU. The Council of the European Union adopted its general approach on this proposal on 28 November 2019, followed by the European Parliament in January 2020. An informal agreement between the co-legislators on a compromise text for this draft law was reached on 22 June. This was endorsed by the Council on 4 November, followed by the Parliament on 24 November.

The Act was signed by the co-legislators on 25 November 2020 and published in the Official Journal on 4 December 2020.
