Regulation (EU, EURATOM) 2020/2092 on a general regime of conditionality aims at protection the European Union's budget against breaches of the principles of the rule of law that affect or risk affecting its sound financial management or the protection of the financial interests of the EU in a sufficiently direct way. TheĀ Conditionality Regulation is a permanent instrument applying beyond the limits of a givenĀ Multiannual Financial Framework (MFF).

The purpose of these guidelines is to explain five aspects of this Regulation:

  • the conditions for the adoption of measures;
  • the relation between the Regulation and other instruments;
  • the proportionality of the measures to be proposed to the Council;
  • the procedure and assessment process;
  • the protection of the rights of final recipients or beneficiaries.

These guidelines were adopted by the European Commission on 2 March 2022, taking into account the judgments of the Court of Justice of the European Union (CJEU) in cases C-156/21 and C-157/21.
