Abstract:

For almost 20 years the ECJ considered in-house contracts as not procurement contracts but doing it yourself. Authors study the codification process of in-house and demonstrate that the process was imperfect. As a result what used to be a rule, might have become an exception. Accordingly researchers should take even a more critical look on the procurement directives. The results of this research demonstrate that a comparative analysis of the procurement directives shows strong discrepancies in the wording, logic and structure, creating a myriad of legal issues to be analysed.
