Summary:

Regulation of the European Parliament and of the Council of 25 March 2019 on the coordination of social security systems following the United Kingdom's decision to withdraw from the European Union.

Further information:

This Regulation aims to safeguard the continuous application of certain core principles of social security coordination as enshrined in Regulation (EC) No 883/2004 on the coordination of social security systems (assimilation, aggregation, equality of treatment), as well as rules which give practical effect to the implementation of those principles (such as the pro-rata calculation of an old-age pension).

In the absence of any provisions to the contrary in a withdrawal agreement, the Regulation will no longer apply to the relations between the EU and the UK. This means that social security entitlements would not be guaranteed for EU citizens who are or have been subject to the legislation of one or more Member States and in situations involving the UK, and also for UK nationals who are or have been subject to the legislation of one or more Member States.

The proposal for this Regulation was adopted on 30 January 2019 as part of the preparedness and contingency plan put forward by the European Commission to mitigate the negative effects of the UK's withdrawal from the EU without the ratification of a withdrawal agreement. Ambassadors from Member States adopted their general approach on behalf of the Council of the European Union on 22 February. The European Parliament's relevant committee approved the draft law on 26 February.
