Summary:Regulation (EU) 2024/2803 - adopted by the co-legislators on 23 October 2024 - revising the legal framework implementing the Single European Sky (SES). This is a text with EEA relevance. Further information:This Regulation lays down rules for the creation and effective functioning of the Single European Sky in order to reinforce air traffic safety standards, to contribute to the sustainable development of the air transport system and to improve the overall performance of air traffic management and air navigation services for general air traffic in Europe. It also comprises a coherent pan-European network, a progressively more integrated airspace, network management and air traffic management systems, based on safety, efficiency, interoperability and technological modernisation. The SES initiative was developed to improve the overall efficiency of the way in which European airspace is organised and managed. The first policy package was delivered in 2004 (SES I), followed by a second package in 2009 (SES II). Despite this body of legislation, costs remained high and delays persisted, also in terms of implementation. The recast originally sought to simplify and clarify the remit between the SES legal framework and the EU Aviation Agency (EASA). The European Commission adopted in June 2013 the so-called SES II+ legislative package to accelerate the implementation of reformed air navigation services, which comprised a draft recast of the legal framework for the SES. The plenary of the European Parliament endorsed a negotiating position on 12 March 2014. The Council of the European Union adopted its own (partial) general approach on 3 December 2014. Unresolved issues concerning the airport in Gibraltar would eventually block any further progress for a number of years. In its 2015 Aviation Strategy for Europe, the Commission urged the co-legislators to swiftly adopt the initiative. The European Parliament adopted a resolution in February 2017 urging the Member States to progress on this dossier. In September 2019, the Parliament's relevant committee agreed to enter trilogue negotiations once possible. In 2019, a Wise Person's Group was set up to assess the situation and future needs for air traffic management in the EU, which resulted in several recommendations. In December 2019, a majority of Member States agreed on the need to work on a full common position. The Commission's European Green Deal published in December 2019 envisaged the restart of work on this proposal, considering its potential impact on aviation emissions. On 22 September 2020, the Commission adopted an amended proposal on the implementation of the Single European Sky, to account for the European Green Deal and also the recommendations of the Wise Person's Group. A separate proposal to amend the EASA Basic Regulation was also put forward. The Council adopted its general approach on 3 June 2021. The Parliament's relevant committee adopted an updated negotiating position on 17 June. After several years of negotiations, an informal agreement between the co-legislators on a compromise text relating to this file was reached on 6 March 2024. This was formally endorsed by the Council on 26 September and by the Parliament on 22 October. The Act was signed by the co-legislators on 23 October 2024 and published in the Official Journal on 11 November 2024. |
