Proposal for a Council Implementing Regulation imposing a definitive anti-dumping duty and collecting definitively the provisional duty imposed on imports of biodiesel originating in Argentina and Indonesia

This proposal concerns the application of Council Regulation (EC) No 1225/2009 of 30 November 2009 on protection against dumped imports from countries not members of the European Community ('the basic Regulation') in the anti-dumping proceeding concerning imports of biodiesel originating in Argentina and Indonesia.

This proposal is made in the context of the implementation of the basic Regulation and is the result of an investigation which was carried out in line with the substantive and procedural requirements laid out in the basic Regulation.

On 29 August 2012 the Commission initiated an anti-dumping proceeding concerning imports of biodiesel originating in Argentina and Indonesia. The Commission imposed provisional anti-dumping duties on these imports by Regulation (EU) No 490/2013 of 27 May 2013.

The attached proposal for a Council Regulation is based on the definitive findings which have confirmed the existence of dumping causing injury, and the fact that the imposition of measures is not against the overall Union interest. It is therefore proposed that the Council adopt the attached proposal for a Regulation which should be published no later than 28 November 2013.
