The authors of this Note argue that because of its textual similarity to the Unfair Terms Directive 1993, Chapter 8 of the proposed Common European Sales Law (CESL), on ‘Unfair contract terms’, can benefit from two decades of interpretative experience, which is likely to provide a comparably high degree of instant legal certainty to contracting parties. |
