The European Commission has taken action against Spain to correct breaches of EU public procurement law. The Commission has decided to send Spain two formal requests, one to end its practices regarding the use of discriminatory technical specifications for the purchase or lease of computer equipment, and the other regarding a public works contract for the construction of a vegetable waste processing plant in Motril, Granada. These requests take the form of "reasoned opinions", the second stage of the infringement procedure laid down in Article 226 of the EC Treaty. If there is no satisfactory reply within two months, the Commission may refer the matter to the European Court of Justice. |
