Abstract: This note examines the judgement of the European Court of Justice in the case C–439/06 of 'Citiworks AG vs. Sächsisches Staatsministerium für Wirtschaft und Arbeit als Landesregulierungsbehörde' dated 22 May 2008 with regard to third party access. Reference is also made to the main elements of the preceding opinion of Advocate General Mazak dated 13 December 2007.
