Abstract:

This book was prompted by the retirement of Judge David Edward from the European Court of Justice in December 2003. The range and content of the contributions from eminent members of the Scottish and Luxembourg judiciary, academics and practitioners represent an appropriate testimonial to a glittering career. The warmth and respect which colours all contributions is indicative of the great affection David Edward inspired from his professional colleagues and Judges of the Court of Session, from his academic colleagues and students, and from his judicial colleagues, his Legal Secretaries and those who have appeared before him as a Judge of the Courts of the European Communities. The Table of Cases is in itself indicative of the realm of influence enjoyed by Judge David Edward.

The contributions are grouped into six parts. Following an introduction, part two looks at the Scottish legal system. Part three covers EU institutional issues, including the European Convention and enlargement. Papers in part four discuss competition issues. Parts five and six cover EU substantive issues, such as free movement, the precautionary principle and the recognition of qualifications, and EU remedies issues respectively.

The book will be welcomed by all those with a genuine interest in Community Law.
