The objective of this Agreement is to allow the transfer of personal data between the European Union Agency for Law Enforcement Cooperation (Europol) and the competent authorities of New Zealand, in order to support and strengthen the action by the authorities of the Member States of the Union and those of New Zealand, as well as their mutual cooperation in preventing and fighting criminal offences, while ensuring appropriate safeguards with respect to the human rights and fundamental freedoms of individuals.

Regulation (EU) 2016/794 was adopted in May 2016 entered into force one year later. The provisions provide that Europol may transfer personal data to an authority of a third country on the basis of an international agreement concluded between the EU and that third country.

Europol and New Zealand's Police signed a working arrangement in April 2019. This provided a framework for structured strategic-level cooperation, but it did not provide a legal basis for the exchange of personal data. Upon formal request from the New Zealand in August 2019, the European Commission added the country in the priority list to start negotiations to lay out that legal basis.

The Council of the European Union adopted a Decision on the signing of the Agreement on 27 June 2022 and on the its conclusion on 14 February 2023. The Agreement was formally published in the European Union's Official Journal on 20 February 2023.
