Abstract:

The purpose of this book is to provide a comprehensive and up-to-date analysis of the EC’s five trade protection laws - those dealing with dumping, subsidies, safeguards, trade barriers and unfair pricing practices in maritime transport, as interpreted and applied by the Community Institutions.

This fourth edition considers all the developments in the EC trade laws and their interpretation at Commission, Council, European Court and WTO levels that have occurred up to mid-March 2004. It presents analysis of the numerous cases decided under the Anti-dumping, Countervailing, Safeguard and Trade Barriers Regulations since the entry into force of the Uruguay Round Agreements on 1 January 1995.

The work is divided into five parts. Part one addresses anti-dumping measures. Sections include the EC framework, elements such as material injury and Community interest, the complaints procedure, anti-circumvention provisions and the WTO framework. Part two deals with subsidies and countervailing measures, while part three covers safeguard measures. Part four examines measures under the Trade Barriers Regulation. Part five addresses the Regulation on Unfair Pricing Practices in Maritime Transport and Airline Services. Part six consists of Appendices containing tables of cases, annexes and an index.

The work will interest scholars, students, practitioners, researchers and policy makers engaged in competition law.
