Book abstract:

This book provides an update on UK and EC competition law. The new edition permits, for instance, the re-introduction of the recitals and preambles to Community secondary legislation, and the main Community legislation on State Aid. It also incorporates new EC guidelines on Vertical Restraints, as well as on Horizontal Co-operation and Block Exemption Regulations.

Structured into six parts, part one deals with UK Statutes: the Fair Trading Act 1973, the Competition Act 1998, and the Enterprise Bill 2002. Part two includes UK Statutory Instruments, like the various Competition Acts of 1998 governing small agreements, penalties, land, and vertical agreements, and part three is on OFT Guidelines. Part four contains EC Primary Legislation, namely the Treaty Establishing the European Community, and part five, on EC Secondary Legislation, incorporates council regulations on implementation, agreement and concerted practices, as well as numerous commission regulations on issues like motor vehicle distribution, technology transfer agreements, and state aid to small and medium-sized businesses. Part six is concerned with EC Commission Notices, on matters as diverse as the definition of the relevant market, the concepts of concentration, undertakings and turnover, as well as the questions of remedies, restrictions, and immunity from or reduction of fines in cartel cases.

The book is specifically aimed at law students.
