Abstract:

The intra-judicial dialogue established with national courts through the preliminary reference procedure has always been central to the ECJ’s role of securing a uniform interpretation and implementation of EU law within the Union.

This article provides an illustration, through the case of Cyprus, of how a new Member State has gradually adapted, both as regards its procedural rules and the practice of its courts, to the particularities of this original system. This national example also allows some general remarks regarding the relationship between the ECJ and national courts and what could be good practices on behalf of national judges.
