Introduction:

On September 6, 2016, the Court of Justice of the European Union handed down the preliminary ruling in the case regarding Aleksei Petruhhin. With this judgment, the Court defined the duties of a member state facing a request to extradite a national of another member state to a state outside the European Union (EU).

The Court’s ruling highlighted the relevance of EU law in the circumstances of the case, namely the freedom of movement of EU citizens and the attendant rights under the Charter of Fundamental Rights of the European Union. Moreover, the Court asserted the priority of surrendering procedures implemented under the European Arrest Warrant (EAW) system over requests of extradition made by non-EU states.
