In the context of the COVID-19 (coronavirus) pandemic, the European Commission adopted Implementing Regulation (EU) 2021/111 putting in place a measure requiring vaccine exports to be subject to an authorisation by Member States. The measure was later extended by Implementing Regulation (EU) 2021/442. Subsequently, Implementing Regulation (EU) 2021/521 was adopted in March 2021 introducing changes to the transparency and authorisation mechanism for COVID-19 vaccine exports. Rules were again extended by the Implementing Regulation (EU) 734, Implementing Regulation (EU) 2021/1071 and Implementing Regulation (EU) 2021/1728.

The European Commission decided in November 2021 not to further extend the existing transparency and authorisation mechanism. As of January 2022, vaccine producers no longer need to request an authorisation for the export of vaccines outside the European Union (EU). Transparency is to be ensured through a new monitoring mechanism, alongside continuous monitoring of the epidemiological situation by the Commission. This mechanism is to allow collection of data on the exports of COVID-19 vaccine doses and the active substances to produce such vaccines at company level. Such data is to be collected by the customs authorities of EU Member States.

This Implementing Regulation was adopted by the European Commission on 25 November 2021 and published in the Official Journal on 26 November 2021.
