Commission Recommendation (EU) 2024/539 on the regulatory promotion of gigabit connectivity

Recommendation adopted by the European Commission on 6 February 2024, concerning the regulatory promotion of gigabit connectivity.

The Recommendation provides guidance to national regulatory authorities (NRAs) about the conditions for accessing the networks of those operators who have significant market power. It seeks to ensure that all operators can access such existing network infrastructure, when appropriate. In this way, it can ensure an adequate regulatory environment, incentivise the switch-off of legacy technologies without undue delay, and foster fast Gigabit network deployment.

The draft text was published by the European Commission on 23 February 2023 as part of a legislative package focusing on connectivity. The Body of European Regulators for Electronic Communications (BEREC) adopted an Opinion as regards the draft Recommendation on 5 May. The final text of the Recommendation was adopted by the Commission on 6 February 2024 and published in the Official Journal on 19 February 2024.
