Abstract:

Changes in competition law between the third edition, which was published in 2002, and this one in 2004 have been numerous. The relationship between Community and national law has been fundamentally redefined, and in this process the application of law relating to agreements has substantially changed, the investigative procedure has been updated, and new rules introduced in relation to penalties and remedies. These and other changes have necessitated major rewriting of much of the book.

The book is organised in six groups, the first consisting of the opening four chapters which deal with basic issues and jurisdiction. Chapters five to seven deal with procedural matters including the ‘new Regulation 17’, Regulation 1/2003. Agreements, including the cartel offence, are covered in chapters eight to twelve. The fourth group, dominance and market failure, are dealt with in chapters thirteen to seventeen. Group five, merger control, is covered in chapters eighteen to twenty and the final chapter discusses the common law of competition in England and Wales.

The work will be useful to undergraduate students of competition law, including law relating to illegal agreements between companies, abuses of dominant positions, mergers, international developments and common law.
