The purpose of this Recommendation is to strengthen operational law enforcement cooperation between law enforcement authorities. Operational law enforcement cooperation covers situations where law enforcement authorities of a Member State of the European Union (EU) operate in the territory of another Member State in the context of cross-border and other trans-national actions between two or more Member States.

It was first proposed by the European Commission on 8 December 2021, following up on its strategy towards a fully functioning and resilient Schengen area and as part of a package establishing an EU Police Cooperation Code.

It aimed at contributing to the creation of common standards to allow policy officers to cooperate effectively with their colleagues in other Member States. Respecting existing EU legislation, and building on good practice in bilateral and multilateral cooperation agreements between Member States, police officers should carry out targeted joint operations, including joint patrols, in particular in intra-EU border areas. As terrorists and other criminals operate across Member States, police authorities should be able to better monitor them, and when engaging in hot pursuits across national territories, be able to detain them as necessary, or conduct surveillance operations in respect of them. Furthermore, joint operations can help in addressing effectively the issue of unauthorised movements of irregular migrants.

The Recommendation was adopted by the Council of the European Union on 9 June 2022 and published in the Official Journal on 13 June 2022.
