Abstract:

This work is a guide to EU law aspects of distribution agreements, aimed especially at legal practitioners and in-house corporate lawyers not necessarily already familiar with European Union institutions and procedures, or with competition law.

The work is comprised of seven chapters. The first presents the background to EU law, EU institutions, the interaction of EU and national law and the content of EU distribution law. Chapter two addresses EU competition law, in particular Articles 81 and 82 of the Treaty of Rome. Chapter three examines distribution agreements and covers such aspects as Agreement Infringement Article 81(1), the Block Exemption Regulation and horizontal distribution agreements. The fourth chapter considers selective distribution. Chapter five examines franchising with particular comment on Articles 81(1) and 81(3). Chapter six covers agency, the relevance of Articles 81 and 82 and the protection of commercial agents. The final chapter looks to the future and plants some signposts to the way ahead.

The work will interest legal practitioners and in-house corporate lawyers as well as students and academics engaged in EU competition law.
