A ruling by the European Court of Justice on 7 September 2004 could result in tens of thousands of taxpayers with shareholdings in EU companies based outside their own country receiving a large tax windfall. The case had been brought to the Court by Petri Manninen, a Finnish taxpayer, who argued that Finland's tax code breaches EU law on the free movement of capital. The Court ruled that tax credit discrimination was a breach of the EU Treaty.
