In a preliminary opinion before the European Court of Justice, Advocate General Ruiz-Jarabo took the view that the proprietor of a trade mark may prevent it being used for commercial purposes by a third party, thus backing Arsenal Football Club's case against a street trader who sold scarves with club emblems outside its London ground.
