Abstract:

This work is based on the proceedings of the WG Hart Workshop 2003. The contributions by leading experts comment upon the state of EU law after fifty years of European Community experience and the current debate on the European Constitution. This volume concentrates on the theme of European Constitutionalism and analyses the proposed Constitution.

The papers dealing with Constitutional Law address such issues as relations between the European Union and Member States, relations between the institutions of the EU, the role of the European Court of Justice, the protection of human rights, and remedies. A primary point of reference is the draft Constitutional Treaty.

The papers dealing with External Relations concentrate on the development of the Union's common foreign, security and defence policies, relations with the world Trade Organisation (WTO), immigration and asylum policy, and the challenges of enlargement.

The final paper explores the challenges posed by the EU Charter of Fundamental Rights, both to the acceding states and to states aspiring to join the EU in the future.

The work will interest scholars, students and practitioners engaged in European Law.
