Article reported that a new challenge to the European Stability Mechanism (ESM), the eurozone’s permanent €500bn rescue fund, was filed in the German constitutional court on the 13 August 2012 by Europolis, a German eurosceptic thinktank. The challenge sought to delay ratification of the establishment of the ESM by Germany until it had sought the opinion of the European Court of Justice in Luxembourg.

if the challenge was granted it would create a legal precedent in Germany because the constitutional court had never before asked the European court for its opinion on a case.

The ECJ had already been asked in August 2012 to rule on a separate case submitted by the Irish supreme court in Dublin.
