Introduction: "According to Article 82 of the EC Treaty, abuse of dominance is prohibited. The case law of the Court of Justice and the Court of First Instance of the European Community gives some guidance concerning whether a certain practice by a dominant firm is abusive or not; however, there is still some uncertainty concerning the exact definition of abusive behaviour. For example, several commentators claim that the court decision in
Michelin II left unanswered many questions concerning which rebates are legal and which are banned."
