ECJ Case C-681/11, Bundeswettbewerbsbehörde, Bundeskartellanwalt v. Schenker and Others. Judgment of the Court of Justice (Grand Chamber) of 18 June 2013.

In this ruling, the Court of Justice appears to eliminate any prospect that an error as to the lawfulness of an undertaking’s conduct could ever be a successful defence against fines for an infringement of the EU competition rules.
