The Hague Programme, a five-year programme for EU justice and home affairs policies, was adopted by the European Council in November 2004 (including policies on visas, asylum and immigration, police and judicial co-operation in criminal matters) and the Council adopted an Action Plan to give effect to this programme in June 2005. The Committee's report examines the constitutional implications of the European Commission's proposals for the implementation of the Hague Programme, including the use of Article 42 of the EU Treaty (the 'passerelle' provision) to transfer action on police and judicial co-operation in criminal matters to the EC Treaty.
