Reviews the European Court of Justice ruling in European Parliament v Council of the European Union (C-658/11) on whether: (1) an EU agreement with Mauritius over the transfer of suspected pirates to the Mauritius authorities should have been adopted under the Treaty on the Functioning of the European Union art.218(6)(a)(v) and therefore required the input of the European Parliament; and (2) whether the delay in informing Parliament of the agreement infringed an essential procedural requirement.
