Judgment of the Court of Justice in Case C-440/05. Commission of the European Communities v Council of the European Union.

The European Community is competent to oblige the Member States to provide for common criminal penalties in order to combat ship-source pollution. The Court of Justice annuls the Council Framework Decision to strengthen the criminal-law framework for the enforcement of the law against ship-source pollution due to its adoption outside the Community legislative framework.
