Book abstract:

This book sets out to describe the nature of judicial protection within European Community law. It attempts both to situate judicial protection firmly within its modern context and demonstrate how the law may develop in the foreseeable future, pointing out flaws in the current system and areas which need to be improved. To illustrate their points, the writers draw on a number of Court cases.

Chapter one provides a description of the Community legal order, including discussions of rules, Treaty provisions, case-laws of the Court, custom, and international law. In chapter two the vital role of the national courts of Member States is analysed. Chapter three explores, among other things, the extent of judicial protection securable against the actions of Community Institutions, chapter four deals with the validity of acts the Member States deploy within the area of Community Law, and chapter five is largely preoccupied with the other miscellaneous tasks carried out by the Court of Justice. In chapter six, the overall structure of the Court of Justice is described, and chapter seven concludes with a discussion of the European Court of First Instance: its organisation, structure, and method of appeal procedure.

The book is primarily aimed at students and practitioners.
