Summary: On 22 October a new law in Hungary came into force which criminalises sleeping rough in public spaces. The new law gives the police the right to order homeless people to go to shelters, as well as to detain them and destroy their personal belongings if they fail to comply three times within ninety days. Further information: Various non governmental organisations argued the law to be unjust and questioned the capacity of the current facilities for homeless people. Though, the Hungarian government said it has allocated funds to expand shelter capacities. The law follows a constitutional amendment that passed June 2018. This amendment made it impossible to appeal the new law in the Constitutional Court, as was the case prior to the amendment. The previous measures taken by the Hungarian government resulted in the EU implementing Article 7, as it disregarded EU rules on democracy, civil rights and corruption. |
