Summary:

Legislative initiative adopted by the European Commission on 18 April 2023, laying down measures to strengthen solidarity and capacities in the European Union (EU) to detect, prepare for and respond to cybersecurity threats and incidents. It is also known as the draft Cyber Solidarity Act.

The use and dependence on information and communication technologies (ICTs) have become fundamental aspects in all sectors of economic activity. The higher uptake of digital technologies increases exposure to cyber security incidents and their potential impacts. At the same time, EU Member States face growing cyber-security risks and overall complex threat landscape, with a risk of rapid spill-over of cyber incidents from one country to others. Cyber operations are increasingly integrated in hybrid and warfare strategies.

An urgent need to increase the exchange of information and improve collective capacities on cybersecurity has been identified, including by the Council of the European Union in October 2021. Support at EU level and solidarity between Member States has been deemed limited regarding detection of cyber threats and incidents.

The proposed Regulation seeks to build a network of cross-border Security Operations Centres (SOCs), thus establishing a European Cyber Shield as announced in the European Commission's EU Cybersecurity Strategy and pursuant of commitments set out in the Joint Cyber Defence Communication. It aims to reinforce the cyber threat detection and information sharing capabilities in the EU through a federation of national and cross-border SOCs. It addresses shortcomings and integrates insights collected from previous actions implemented in this regard. It also foresees the creation of a Cyber Emergency Mechanism and a European Cybersecurity Incident Review Mechanism.
