Regulation (EC) No 1071/2009 aims to improve consistent application of rules for admission to the road transport operator business. Regulation (EC) No 1072/2009 lays down rules applicable to access to the market in the international carriage of goods by road within the European Union (EU). It also lays down the conditions under which non-resident hauliers may operate transport services within a Member State. Regulation (EU) No 1024/2012 lays down rules on the use of the Internal Market Information (IMI) system for administrative cooperation.

A REFIT assessment to the two first Regulations was carried out and concluded that they were only partly effective in achieving their original objective of creating suitable competitive conditions in the market. The main difficulties encountered were linked to shortcomings of the rules and their enforcement. The European Commission tabled the proposal for this Regulation on 31 May 2017 to rectify the identified shortcomings.  The proposal was put forward as part of the Europe on the Move package. The Council of the European Union adopted its general approach in December 2018, followed by the European Parliament in April 2019. After four negotiating rounds, an informal agreement was reached between the co-legislators on a compromise text in December 2019. This was formally endorsed by the Council in April 2020 and by the Parliament in July 2020. The co-legislators signed off the Act on 15 July, which was published in the Official Journal on 31 July 2020.
