Regulation of the European Parliament and of the Council of 5 June 2019 on the establishment and functioning of the EU Agency for the Cooperation of Energy Regulators (ACER).

The Agency for the Cooperation of Energy Regulators (ACER) is an EU agency with a governance structure specifically tailored to the EU energy market. Its role is to coordinate the regulatory decisions of independent national regulators. The existing legislative framework is based on Regulation (EC) No 713/2009 which established the agency.

In November 2016 the European Commission presented a proposal to recast the legal acts setting out the rules relating to ACER and to the European Network of Transmission System Operators for Electricity (ENTSO-E). The Commission's understanding was that an integrated market and a cross-border infrastructure should be overseen by a more powerful agency. The proposal was adopted as part of the 'Clean Energy for All Europeans' legislative package.

The European Parliament's relevant committee approved its position and mandate for negotiations on 21 February 2018. The Council of the European Union adopted its general approach on the proposal on 11 June.
