Regulation (EU) No 168/2013 aims to upgrade the EU's functional safety and environmental requirements for L-category vehicles as a prerequisite for vehicle registration. According to this legislation, the pollutant emissions Euro 5 step were due to apple on 1 January 2021. This meant that as of that date only vehicles meeting the Euro 5 requirements could be places on the market across the European Union.

The COVID-19 (coronavirus) pandemic caused an impact on the motorcycle industry, not least disruption of production sites and a sizeable drop in demand and increase of vehicles in stock. The pandemic affected the manufacturers' ability to meet some of the deadlines imposed by Regulation (EU) 168/2013. In particular, it became difficult for non-Euro 5 vehicles to be sold as expected before the deadline. Given the disruption, the amendments consider that existing provisions on end-of-series do not constitute an appropriate mechanism to address this situation.

The proposal was tabled by the European Commission on 7 September 2020. It was formally adopted by the Council of the European Union and the European Parliament on 11 November 2020. It was published in the Official Journal on 13 November 2020.
