Summary: Regulation (EU) 2020/696 - adopted by the European Parliament and Council of the European Union on 25 May 2020 - which introduces a number of temporary amendments to Regulation (EC) No 1008/2008 in light of the changing reality caused by the COVID-19 (coronavirus) pandemic. Further information: The pandemic led to a sharp drop in air traffic as a result of a significant reduction in the demand for transport and the adoption by Member States and third countries of direct measures to contain the virus outbreak. Decreasing demand and the high rate of cancellations led to severe liquidity problems for otherwise healthy air carriers. These problems could trigger the suspension or revocation of their operating licence, or its replacement by a temporary licence. Such situation could send a negative signal to the market about the ability of an air carrier to survive, which in turn would further aggravate any financial problems. The co-legislators considered that it would be appropriate that the operating licence of such air carriers was not suspended or revoked, provided that safety was not at risk and there was a realistic prospect of satisfactory financial reconstruction within 12 months. At the same time, Member States should be able to refuse, limit or impose conditions on the exercise of traffic rights in order to deal with problems resulting from the pandemic, which can be of longer duration than otherwise already allowed by Regulation (EC) No 1008/2008. The Regulation also includes amendments relating to ground-handling services and extension of airport contracts. The proposal for this Regulation was adopted by the European Commission on 29 April 2020. The plenary of the European Parliament formally endorsed the initiative on 15 May, followed by the Council of the European Union on 25 May. The Act formally signed by the co-legislators on that same day. The Regulation was published in the Official Journal on 27 May 2020. |
