This Regulation implements into EU Law management, conservation and control measures established by the Indian Ocean Tuna Commission (IOTC) that are binding on the European Union. It introduces amendments to Council Regulation (EC) No 1936/2001 addressing conservation of certain stocks of migratory fish, Council Regulation (EC) No 1984/2003 introducing a system for the statistical monitoring of trade in bluefin tuna, swordfish and bigeye tuna within the EU, and Council Regulation (EC) No 520/2007 addressing the conservation of highly migratory species.

The draft law was adopted by the European Commission on 11 March 2021. Its purpose was to transpose into EU Law the control, conservation and management measures adopted by the Indian Ocean Tuna Commission (IOTC), to which the European Union has been a contracting party since 1995. The IOTC is the regional fisheries management organisation (RFMO) responsible for managing tuna and tuna-like fishery resources in the Indian Ocean.

The plenary of the European Parliament endorsed a mandate for negotiations on 15 December 2021. Member State representatives adopted a general approach on behalf of the Council of the European Union on 19 April 2022. An informal agreement between the co-legislators on a compromise text for the file was reached on 7 June. This was formally endorsed by the Parliament on 4 October, and by the Council on 24 October. The Act was signed on 23 November 2022, and published in the Official on 2 December 2022.
