Abstract:

This work moves from the premise that competition is good for society and effective competition must be protected. Competition law is one of the fastest growing and increasingly important areas of law in the European Union. The book addresses the four principal fields that entail enforcement of substantive competition rules: antitrust, merger, anti-dumping/anti-subsidies and state aid.

The book is organised over five chapters, preceded by an introduction and followed by a conclusion, and supported by three tables. Each of the above mentioned fields is subjected to individual analysis of the procedures in three different stages: the initiation of proceedings, the fact finding procedure, and the final stage at which the initial findings of the Commission are open to challenge by the target undertakings and other interested parties. This analysis absorbs the first four chapters. The fifth chapter undertakes a comparison analysis of the four procedures to identify similarities and differences, then goes on to test the justification of those differences and provide explanations for their existence.

The book will be useful to lawyers, judges and case handlers engaged in European competition law as well as jurists and academics.
