The judgment in Football Association Premier League Ltd, NetMed Hellas SA, Multichoice Hellas SA v QCLeisure et al marks a further step in the relationship between EU law and sports as the Court, for the first time, refers to Article 165 of the Treaties of the European Union, which contains an explicit provision on sports. The judgment is furthermore not only relevant for the protection of intellectual property rights in the EU, but most notably sheds light on a number of classic internal market law issues, such as the scope of the free movement rules, the protection of overriding requirements of general interest, EU competition law and the relationship between the EU competition rules and rules on free movement. In this case note the focus is therefore laid on the questions relating to the application of EU Internal Market law to broadcasting of premier league matches.
