Introduction:

"Section B of the paper discusses the basic issue of the nature of price squeeze abuses. In light of the conclusions drawn in section B and the recent developments in US and EU antitrust practice, the following sections analyse some of the most controversial issues in the treatment of price squeeze, namely: (i) the admissibility and utility of an analytical framework for the assessment of price squeeze under antitrust law (section C); (ii) the need for a duty to deal based on antitrust rules and, possibly, other sets of rules (section D); and (iii) the structure of the cost-based test (section E). In addition, section F provides some additional remarks on the role of efficiencies in price squeeze cases, taking into account the indications provided by the Guidance. Section G presents conclusions."
