Book abstract:

With European economic and monetary union now a reality, state measures continue to distort free competition in the EU and are even more likely to threaten the efficiency and functioning of the single market. This work examines the distortions that remain and looks at how these might be removed, providing a useful analysis and evaluation of the complex mechanisms involved in this complicated area of Community law.

The book is organised in 4 parts. Part A gives a comprehensive introduction to competition law in the Community's legal system. Relevant community primary legislation is dealt with in Part B with chapters on 'Different Types of National Measures Distorting Competition' and 'The Aims and Principles of the Treaty in relation to Competition' amongst others. In part C the discussion moves towards exposing the limits of case law, raising the need for stronger Community policy in the field of anti-competitive State measures, and a move towards more stable currency rates through fixed currency exchange rates within the EMU. The way forward or as Professor Von Quitzow might put it - the path of enlightenment - is suggested in Part D 'Possible Future Developments concerning State Measures Distorting Free Competition'. He asserts that Member States will need to examine past traditions of State planning and steering of economic life, monopolies, restricted practices from fresh perspectives.

The work will interest students, scholars, practitioners and policy makers in Community Law.
