The crime (international co-operation) bill [HL]: ‘Hot surveillance’. Bill 78 of 2002-03

This paper looks at some of the provisions of Part 4 of the 'Crime (International Co-operation) Bill, which was introduced in the UK House of Commons as Bill 78 of 2002/03 on 18 March 2003. The main part of the paper looks at the provisions on cross-border surveillance contained in clauses 82 to 84 of the Bill. These are intended to implement Article 40 of the 1990 Schengen Convention, which allows police and customs officers of one Member State to continue their surveillance of a person suspected of a serious crime into another Member State for up to five hours in an emergency. Other topics covered by this paper are: information, extradition and false monetary instruments.
