The EU as an actor at the WTO: its strengths and weaknesses throughout history

Abstract:

During the last decade, many reforms took place in the European Union legal and policy framework. Some of those reforms were motivated by the participation of the European Union and its member States in the World Trade Organization. This paper aims to analyze the role of the European Union as an actor in that organization, paying special attention to its mixed legal nature – EU and Member States. With that purpose, the evolution of the relationship between the EU member States and the EU itself as simultaneous actors at the WTO is studied. The division of competences is also reviewed.

Finally, the analysis of the EU position in different negotiation rounds (Uruguay, Doha) for the agricultural sector is reviewed as an example of the evolution in the protection of European interests. The paper shows that some changes in the Treaty of Lisbon have strengthened the legal framework for the EU to be heard with a unique voice in the WTO.
