Set of conclusions adopted by the Working Party on Cooperation in Criminal Matters (COPEN) of the Council of the European Union on 23 November 2020, concerning the challenges and the way forward regarding the European Arrest Warrant (EAW) and extradition procedures.

In its conclusions, the Council agrees that there is scope for improvement in five areas:

  • improving national transposition and the practical application of the European Arrest Warrant Framework Decision;
  • supporting executing authorities in dealing with fundamental rights evaluations;
  • addressing certain aspects of the procedure in the issuing and in the executing Member State;
  • handling requests to extradite EU citizens to third countries;
  • strengthening EAW surrender procedures in times of crisis, following the experience of the COVID-19 (coronavirus) pandemic.
