Date: 21/01/1999 ...ruled this week that Greece violated EU lawsgoverning the free movement of people when it expelled an Italian national for life after she was convicted of drug use and possession while on a Mediterranean holiday. The case was brought by Donatella Calfa, who argued that the punishment unfairly discriminated against foreigners. The Court ruled that member states could only expel a foreigner convicted of a crime if the person posed a genuine threat to “public policy”. |
