Case-law by the Court of Justice has clarified many important aspects of the two anti-discrimination directives. This report aims to provide a comprehensive overview of the evolution of this case-law and the general interpretative approach that has been adopted by the Court of Justice in this context. The report also seeks to analyse the pattern of cases concerning the 2000 Directives which have reached the Court, identifies residual areas of uncertainty and examines how the Court’s case-law may continue to develop in the years to come.

This overview thus provides an opportunity to take stock of how the case-law of the Court has developed over the last decade. It also examines the impact of this case-law on national law and analyse the evolution of the Court’s jurisprudence.
