Abstract:

The yearbook of European environmental law brings together topical analyses of contemporary European environmental law. The main part of the book contains in-depth scholarly articles by European and American academics, covering a wide range of challenging issues. Chapters include: Environmental regulation in federal systems; Flexibility in the implementation of EC environmental law; From Danish bottles to Danish bees: the dynamics of free movement of goods and environmental protection - a case law analysis; EC environmental law and self-regulation in the member states: in search of a legislative framework; European Community eco-labelling in transition; Judicial review of environmental misconduct in the European Community: problems, prospects and strategies; The legal framework for the regulation of waste in the European Community; Environmental NGOs and EU environmental law; Challenges and opportunities in EC waste management: perspectives on the problem of end of life vehicles; The environmental guarantee after Amsterdam: does the emperor have new clothes?; and The private enforcement of member state compliance with EC environmental law: an unfulfilled promise?

The second part of the book is a survey of the current state of EC environmental law, summarising developments in the key areas of atmospheric pollution, chemicals and biotechnology, nature conservation, waste, water, 'horizontal instruments' such as the environmental impact assessment and eco-management and audit scheme; other policy instruments such as action programmes and state aids, and finally, case law of the European Court of Justice.

The third part of the book has a brief summary of the situation in each of the Member States, while the book concludes with reviews of five books published between 1996 and 1998 on the subject of European environmental law. Additionally, the book includes the text of key documents, tables of cases and key legislation and a detailed index. The book will be invaluable to academics, students and practitioners alike, to bring them up-to-date on this key area of EU interest and provide a reference volume for easy access to the relevant legislation and current developments.
