Abstract:

New global rules agreed in June 2013 by the Internet Corporation for Assigned Names and Numbers (ICANN) mean that personal data of anybody registering a website domain name will be retained by private companies for up to two years. The provisions were included following demands made by law enforcement agencies and governments of the ‘Five Eyes’ intelligence alliance countries – Australia, Canada, New Zealand, the United Kingdom and the United States. EU member states’ data protection authorities have argued that the new rules are illegal, an argument dismissed by both the European Commission and ICANN.
