Justice and Home Affairs Council, 3-4 March 2022

Summary:

A meeting of the Justice and Home Affairs Council (JHA) was held on 3-4 March 2022. The agenda included the following items:

• Activation of Council Directive 2001/55/EEC allowing for the establishment of a temporary protection mechanism in response to the influx of displaced persons from Ukraine;
• First meeting of the Schengen Council:
  • Discussion the barometer proposed by the European Commission to reflect the situation in the Schengen area;
  • Adoption of general approach on proposed Regulation reforming the Schengen evaluation and monitoring mechanism;
• Update on the state of work on migration and asylum;
• Adoption of conclusions calling for the adaptation of civil protection systems to extreme weather events resulting from climate change;
• Adoption of Declaration on Interpol's red notices;
• Discussion between EU ministers and CLASI ministers on cooperation in the fight against transnational organised crime;
• Update from the Council Presidency on the latest developments regarding work on active legislative proposals;
• Update on the state of play of trilogue negotiations concerning the proposals on electronic evidence;
• Discussion on a proposed Council Decision adding hate speech and hate crime to the list of EU crimes included in the TFEU;
• Exchange of views with the Director of the EU FRA on combatting racism and antisemitism, followed by the adoption of conclusions on this matter;
• Discussion on the issue of access to a lawyer and the role of such access in the protection of the rule of law, based on a paper from the Council Presidency;
• Presentation by the European Commission of its legislative initiatives on corporate due vigilance in the area of sustainability and on data;
• Discussion on the EU response to the consequences of the war in Ukraine.
